Euro Auto Design — Terms of Service
These Terms of Service ("Terms") govern your use of euroautodesign.com (the "Site") and purchases from Euro Auto LLC, doing business as Euro Auto Design ("Euro Auto Design," "we," "us," or "our"). "You" means the person using the Site or placing an order.
By using the Site or placing an order after these Terms are displayed or linked, you agree to these Terms. If you place an order for an organization, you represent that you are authorized to bind it. You must be at least 18 years old or the age of legal majority where you live to place an order.
1. Related Policies
The following policies are incorporated into these Terms:
- Shipping Policy — covering processing, production, delivery estimates, tracking, customs, and shipping concerns.
- Refund & Return Policy — covering cancellations, returns, refunds, restocking fees, made-to-order products.
- Warranty Policy — covering eligible defects, exclusions, claim requirements, and warranty remedies.
- Privacy Policy — explaining how we collect, use, and disclose personal information.
The policy addressing a particular subject controls the operational details for that subject. A product-specific written promise presented before purchase controls if it gives you greater protection. Nothing in these Terms or the related policies limits a right or remedy that cannot legally be waived. If a provision conflicts with mandatory law, the law controls and the remaining provisions continue to apply.
Terms and policies in effect when an order is placed govern that order. Later changes will not retroactively reduce rights relating to an earlier order.
2. Site Use
You may use the Site only for lawful purposes. You may not:
- interfere with the Site's operation or security;
- introduce malicious code or attempt unauthorized access;
- use automated tools to scrape, copy, or commercially exploit Site content without written permission;
- submit false information, impersonate another person, or use a payment method without authorization; or
- use the Site or our products in violation of applicable law or another person's rights.
We may restrict Site access, refuse service, or cancel an unshipped order when reasonably necessary to address fraud, abuse, a security threat, a legal requirement, an obvious listing error, or product unavailability. If we cancel a paid order, we will issue the refund required by applicable law.
3. Products, Fitment, and Aftermarket Characteristics
We make reasonable efforts to provide accurate descriptions, photographs, specifications, compatibility information, pricing, and availability. Screen settings, lighting, photography, supplier updates, and manufacturing processes may cause minor differences in color, finish, reflection, weave, packaging, or nonmaterial details. These normal variations do not permit a materially different product substitution and do not override the Limited Warranty.
Unless expressly stated otherwise, products sold on the Site are aftermarket products and are not manufactured, sponsored, or endorsed by the vehicle manufacturer. Vehicle and third-party trademarks are used only to identify compatibility.
You are responsible for selecting the correct year, make, model, trim, package, body style, bumper, headlight type, connector, factory option, and other configuration shown at checkout. If you are uncertain, contact info@euroautodesign.com before ordering. If you reasonably relied on incorrect written fitment guidance supplied by Euro Auto Design for the information you provided, we will review the matter under the Refund & Return Policy and applicable law.
Aftermarket products may require product-appropriate alignment, test-fitting, trimming, drilling, adhesive, additional hardware, coding, calibration, or minor bodywork. Professional installation is strongly recommended for carbon-fiber body parts, exterior aero, lighting, electrical products, steering wheels, grilles, and body panels. Installation by a third party or by the customer does not automatically eliminate warranty coverage, but damage caused by installation, modification, or vehicle-side conditions is not a product defect. The Limited Warranty contains the complete installation and claim requirements.
You are responsible for determining whether a product and its intended use comply with local vehicle, lighting, emissions, inspection, registration, and road-use laws. Nothing in this section excludes liability for a defective product or inaccurate representation where liability cannot legally be excluded.
4. Orders and Fulfillment Classification
Your order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt; it does not prevent us from correcting an obvious pricing or listing error, declining a suspected fraudulent transaction, or canceling an unavailable item. If we cannot accept a paid order, we will notify you and issue the refund required by law.
Products may be stocked, supplier-allocated, special-order, configured, bespoke, or made to order. A product's category alone does not always identify its fulfillment method: many carbon-fiber and lighting products follow standard processing, while certain products in the same categories require production or configuration. The Shipping Policy explains the applicable processing ranges and examples. To confirm how a specific product will be fulfilled, contact info@euroautodesign.com before purchasing.
Any cancellation or return restriction based on a product's fulfillment classification is governed by the Refund & Return Policy and applies only to the extent permitted by law. Order changes are not guaranteed after processing, allocation, or production begins.
5. Prices, Taxes, and Payment
Prices and promotions may change without notice but will not change the price of an accepted order, except to correct an obvious error with notice to you. You are responsible for applicable sales, use, import, and similar taxes or charges unless they are collected at checkout or expressly included.
You represent that your order and payment information is accurate and that you are authorized to use the selected payment method. We and our payment providers may authorize, verify, capture, decline, or refund payments and use reasonable fraud-prevention measures.
Please contact us promptly about a billing or order problem. Nothing in these Terms restricts your right to make a good-faith billing inquiry, report unauthorized use, or exercise rights provided by law or payment-network rules. If you receive a refund, reversal, or chargeback credit while retaining the product, we may request return of the product or payment of any amount lawfully owed. After notice and an opportunity to resolve the matter, we may pursue lawful collection or legal remedies. We do not impose automatic chargeback penalties or administrative fees under these Terms.
6. Shipping, Tracking, and Delays
The Shipping Policy governs processing and production periods, estimated delivery, tracking behavior, international duties, incorrect addresses, refused packages, and delivery investigations. All stated dates and ranges are good-faith estimates unless expressly identified as guaranteed.
A tracking status, delivery photograph, signature, or carrier GPS record may be considered as evidence, but no single record overrides facts establishing nondelivery, misdelivery, damage, or our error. We will reasonably cooperate with an appropriate carrier investigation as described in the Shipping Policy.
Events outside our reasonable control — including carrier interruptions, customs, weather, material shortages, governmental action, labor disruptions, or transportation failures — may cause delay. This does not eliminate any notice, cancellation, refund, or other right that applicable law makes mandatory. When applicable law requires us to offer you a choice between consenting to a shipping delay and canceling for a refund, that choice remains available regardless of a final-sale or made-to-order designation.
7. Cancellations, Returns, and Refunds
The Refund & Return Policy governs cancellation windows, return eligibility, authorization requirements, item condition, shipping responsibility, restocking fees, store credit, and refund processing.
The 72-hour reporting period is intended for visible delivery damage, missing components, incorrect items, and other conditions that can reasonably be found through prompt inspection. It does not eliminate Limited Warranty coverage for a hidden defect that could not reasonably have been discovered during that inspection or any non-waivable right.
Voluntary returns must satisfy the condition requirements in the Refund & Return Policy. Installation or modification may prevent a voluntary return and may affect a defect claim when it caused the issue or prevents reasonable verification. It does not automatically eliminate a claim for an independently verifiable defect that existed when the product was delivered.
Custom, configured, special-order, supplier-allocated, and made-to-order products may be final sale as stated in the Refund & Return Policy.
8. Limited Warranty
Eligible products are covered by our 90-Day Limited Warranty. A product page or separate written warranty may provide longer or additional coverage; if so, the more favorable written coverage applies to that product.
The Limited Warranty explains what is covered, what is excluded, how to submit a claim, what evidence may reasonably be requested, and the available remedies. Any manufacturer's warranty supplied with a third-party branded product is administered under that manufacturer's terms unless we expressly state otherwise.
Nothing in these Terms disclaims or limits an implied warranty, statutory guarantee, or remedy that cannot legally be disclaimed or limited.
9. Reviews, Photos, and Other Submissions
If you voluntarily submit a review, photograph, video, testimonial, suggestion, or other content to us for publication, you represent that you own it or have permission to provide it and that it does not violate another person's rights. You grant Euro Auto Design a nonexclusive, worldwide, royalty-free license to display, reproduce, edit for formatting, and use that content to operate and promote our business, together with the name or social-media handle you authorize us to use.
This license does not transfer your ownership. You may ask us to stop future use by contacting us, although we may retain records required for completed campaigns, legal compliance, or content already incorporated into printed material. Reviews must reflect genuine experiences, and any incentive will be disclosed where required.
10. Intellectual Property
The Site and its original text, photographs, videos, graphics, logos, designs, layout, and software are owned by or licensed to Euro Auto Design and are protected by intellectual-property laws. Except for ordinary personal browsing and shopping, you may not reproduce, modify, distribute, scrape, sell, or commercially exploit Site content without written permission.
Third-party names, product designs, and trademarks remain the property of their respective owners. No reference to a third party implies sponsorship or endorsement unless expressly stated.
11. Third-Party Services
The Site may use or link to third-party services, including payment processors, financing providers, carriers, tracking services, installers, social platforms, and external websites. Their services may be governed by separate terms and privacy practices. We are not responsible for an independent third party's website or acts, but this sentence does not excuse Euro Auto Design from obligations that applicable law assigns to us as the seller.
Financing approval, payment schedules, interest, and financing disputes are governed by the agreement between you and the financing provider. A financing provider's decision does not change our Shipping, Refund & Return, or Limited Warranty obligations.
12. Website Disclaimer
The Site is provided on an "as available" basis. To the fullest extent permitted by law, we do not guarantee that it will always be uninterrupted, secure, error-free, or free of harmful code. Product purchases are governed by the express promises in the product listing, these Terms, and the related policies — not by this website-service disclaimer.
No installation guidance, fitment assistance, or general information on the Site replaces inspection and work by a qualified automotive professional when professional judgment is appropriate.
13. Limitation of Liability
To the fullest extent permitted by law, Euro Auto Design and its officers, employees, and affiliates will not be liable for indirect, special, incidental, exemplary, punitive, or consequential damages arising from the Site, an order, or a product, including lost profits, lost income, loss of use, vehicle downtime, rental expense, or third-party labor, except where such damages are expressly covered by the Limited Warranty, approved by us in writing, or recoverable under mandatory law.
To the fullest extent permitted by law, our aggregate liability for a claim relating to a product or order will not exceed the amount paid for the product or order giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury or property damage where a limitation is prohibited, statutory damages that cannot be limited, or any other liability or remedy that cannot legally be excluded. Some jurisdictions do not allow particular exclusions or limitations, so some or all of this section may not apply to you.
14. Indemnification
To the extent permitted by law, you will indemnify Euro Auto Design against a third-party claim to the extent caused by your intentional unlawful use of the Site or a product, your infringement of a third party's rights through content you submit, or your material breach of these Terms. This obligation does not apply to a claim caused by our own negligence, unlawful conduct, inaccurate representation, or a product defect for which we are legally responsible.
15. Disputes, Governing Law, and Orange County Venue
Please contact info@euroautodesign.com before escalating an order issue so we have an opportunity to investigate and propose a resolution. Contacting us first is encouraged but is not a condition to exercising a right that applicable law or payment-network rules allows you to exercise immediately.
These Terms and transactions with Euro Auto Design are governed by California law, without regard to conflict-of-law principles. This choice does not deprive a consumer of mandatory protections provided by the law that applies where the consumer resides or where the transaction occurred.
Exclusive Orange County forum. To the fullest extent permitted by law, you and Euro Auto Design agree that every dispute, claim, or proceeding arising from or relating to the Site, these Terms, an order, or a product must be brought exclusively in the state courts located in Orange County, California, or the federal court with jurisdiction over Orange County. Each party consents to the personal jurisdiction of those courts.
Small claims. An eligible individual claim may be brought in the Small Claims Division of the Superior Court of California, County of Orange, when Orange County is a legally proper venue.
16. International Consumer Rights
If you purchase as a consumer outside the United States, nothing in these Terms or the related policies excludes mandatory rights concerning delivery, cancellation, conformity, repair, replacement, refund, or damages under the law applicable to your transaction. Any exception for genuinely personalized or custom-made goods applies only where recognized by that law.
For consumers in Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
17. Changes and Termination
We may update the Site, these Terms, or a related policy by posting a revised version and effective date. Changes apply prospectively. The version presented or linked when you order continues to govern that order unless you agree to a later change or the change is required by law.
We may suspend or discontinue Site access, but doing so does not cancel obligations concerning an existing order, refund, warranty claim, or other accrued right.
18. General Terms
If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue. Our failure to enforce a provision once is not a waiver. We may assign these Terms as part of a merger, reorganization, financing, or sale of our business; you may not assign an order or claim without our consent except where law permits.
These Terms, the incorporated policies, the product listing presented at purchase, and any order-specific written agreement constitute the agreement concerning the Site and your order. They do not override a later written resolution signed or expressly accepted by both parties.
Electronic communications and records may be used to administer your order and document the transaction as permitted by law. If a translated version conflicts with the English version, the English version controls except where applicable law requires otherwise.
